Credit Card Debt Port Richey

We help our clients develop a plan to pay off their debts, and strive to save our clients as much money as possible without filing for bankruptcy.

Our experience shows that creditors are willing to settle debts for less than the amount due for many reasons, including avoiding litigation costs and expenses, avoiding payment delays, and receiving a certain sum of cash in lieu of fighting for a judgment that may or may not be collectible.

Unlike many of the "debt settlement" companies:

  1. We are a LOCAL LAW FIRM with real lawyers (not merely attorney owned or attorney based) actually practicing law in the geographic areas that we are licensed.
  2. We do NOT sell off client accounts to others to do the back office work (i.e. the work of negotiating settlements). For years, "debt settlement" companies have paid commissions or referral fees to telemarketers, etc. for signing people up into a debt settlement program (they basically split your "fees" 50/50, 60/40 and even 70/30 between the front end solicitation company and back end settlement company).
  3. We handle ALL negotiations and settlements out of our main office.
  4. We can and do help our clients defend credit card lawsuits, garnishments, repossessions and executions because we are a local law firm with real lawyers practicing law. "Debt settlement" companies usually state in their agreements that creditors can sue you and that they will not represent you in those lawsuits.
  5. We place your debt settlement plan payments into a trust account regulated by the bar of each state we practice in (i.e. The Florida Bar, etc.) at NO charge. "Debt settlement" companies usually require you to use specialized accounts that charge monthly fees you have to pay for to keep your funds separate from other's funds.
  6. We do not have bad ratings with our local bars or the Better Business Bureau. Many "debt settlement" companies have D and F ratings with the Better Business Bureau and are not regulated by their local bars because they are not law firms, but rather "attorney-based" debt settlement companies.

Is our debt settlement program right for you?

Our clients typically choose to settle their debts with us for a credible way of resolving their debts while avoiding bankruptcy. They also choose to do so when they are not eligible for bankruptcy or would have to pay far more in a Chapter 13 or Chapter 11 bankruptcy plan than they would have to pay if they simply settled their debts with us for less than the amount due.

We pride ourselves in leaving all applicable options on the table so that you can decide which one(s) are best for you without having multiple people from different companies soliciting you to do what they are pitching you (i.e. bankruptcy lawyer telling you to file bankruptcy, telemarketer telling you to sign up for their debt settlement program so they can earn a commission, realtor telling you to short sale your home, another solicitor telling you to hire them to modify your mortgage so they can earn a commission, etc.)

In a consultation with us, you can expect us to discuss the debt settlement option (amongst the other applicable options). Then you can decide what makes most sense for you.

The federal government passed new bankruptcy reform legislation in October 2005. However, don't be discouraged! Most studies indicate that the new law affects less than 15% of individuals who could have filed previously. If you are feeling overwhelmed by your debts and considering filing bankruptcy, it is highly probable that you fall into the category of the 85 percent of people who are still eligible to file.
